001 — ABOUT XY CYBER
XY CYBER provides cybersecurity technology designed to help organizations understand security signals, identify relevant risks, and support more proactive security decisions.
Features and capabilities may change as the Service develops.
002 — ACCESS AND ACCOUNTS
Some parts of the Service may require an account, invitation, or approved access.
You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account.
You must provide accurate information when creating or requesting an account and promptly notify us if you believe your account or credentials have been compromised.
Access to beta, preview, evaluation, or early-access features may be limited, changed, or discontinued at any time.
003 — ACCEPTABLE USE
You may use the Service only for lawful and authorized purposes.

- Attempt to gain unauthorized access to XY CYBER, its systems, accounts, or infrastructure.
- Interfere with or disrupt the operation, security, or integrity of the Service.

- Use the Service to unlawfully access, attack, monitor, or interfere with systems you do not own or have permission to assess.

- Copy, reverse engineer, decompile, or attempt to extract source code except where such restrictions are prohibited by applicable law.
- Use the Service in a way that violates applicable law or the rights of others.
We may restrict or suspend access where reasonably necessary to protect the Service, our users, or third parties.
004 — CUSTOMER DATA AND INTEGRATIONS
You retain your rights in data and information you provide to or connect with the Service.
You authorize XY CYBER to process that information as necessary to provide, secure, maintain, and support the Service.
You are responsible for ensuring that you have all rights, permissions, and lawful authority required to provide data to XY CYBER or connect third-party systems and services.
Third-party products and integrations may be subject to their own terms and privacy practices.
005 — AI-GENERATED OUTPUTS AND SECURITY INFORMATION
The Service may use automated systems or artificial intelligence to analyze information, identify patterns, prioritize risks, generate findings, or provide recommendations.
These outputs are intended to support security professionals and decision-making. They should not be treated as a guarantee that a threat, vulnerability, attack path, or security incident will or will not occur.
You remain responsible for evaluating outputs and determining what actions are appropriate for your organization, systems, and security environment.
006 — INTELLECTUAL PROPERTY
XY CYBER and its licensors retain all rights, title, and interest in the Service, including its software, design, technology, documentation, trademarks, and other intellectual property.
Except for the limited right to use the Service under these Terms, no rights are transferred to you.
You retain ownership of your own data and materials, subject to the rights necessary for XY CYBER to provide the Service.
007 — BETA AND EARLY-ACCESS SERVICES
Certain features may be provided as beta, preview, evaluation, or early-access functionality.
Such features may be incomplete, change without notice, contain errors, or be discontinued.
Beta and early-access features are provided for evaluation and feedback and should not be relied upon as the sole basis for critical security decisions unless otherwise agreed in writing.
008 — SERVICE AVAILABILITY
We work to maintain a reliable and secure Service, but we do not guarantee uninterrupted or error-free availability unless a separate written agreement expressly provides otherwise.
The Service may occasionally be unavailable due to maintenance, upgrades, security measures, third-party dependencies, or circumstances outside our reasonable control.
009 — FEES AND PAID SERVICES
If you purchase paid access to the Service, pricing, billing terms, subscription periods, and any applicable usage limits will be presented in the applicable order, plan, or separate agreement.
You are responsible for providing accurate billing information and paying applicable charges according to those terms.
Where a separate written agreement governs billing or commercial terms, that agreement will control in the event of a conflict.
010 — DISCLAIMERS
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis unless otherwise agreed in writing.
Cybersecurity involves inherent uncertainty. No security technology can identify, predict, prevent, or eliminate every threat, vulnerability, or incident.
XY CYBER does not guarantee that use of the Service will make your systems completely secure or that every finding, prediction, recommendation, or output will be complete or error-free.
011 — LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, XY CYBER will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the Service.
Any additional limitations, exclusions, or liability caps applicable to a paid customer may be specified in the relevant order or separate written agreement.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
012 — TERMINATION
You may stop using the Service at any time.
We may suspend or terminate access if you materially violate these Terms, create a security risk, use the Service unlawfully, or where suspension is otherwise reasonably necessary to protect XY CYBER, our users, or third parties.
Provisions that by their nature should survive termination will continue to apply.
013 — CHANGES TO THE SERVICE OR TERMS
We may update the Service and these Terms from time to time as XY CYBER develops.
If we make material changes to these Terms, we may provide notice where appropriate or required by law.
The updated Terms will display a revised “Last updated” date.
